These Terms of Use ("Terms") govern access to and use of the RIFT platform (the "Platform"). By accessing or using the Platform, any user ("User") agrees to be bound by these Terms. If a User does not agree, access to the Platform must be discontinued.
The Platform is a technology-based marketplace that enables property owners and prospective buyers to exchange information regarding potential real estate opportunities. The Platform does not act as a broker, agent, advisor, or intermediary in any transaction.
RIFT is not a licensed real estate brokerage firm and does not provide brokerage services. RIFT does not represent buyers or sellers, does not negotiate transactions, and does not provide legal, financial, or real estate advice. All interactions and transactions between users occur independently of the Platform and at the sole risk of the parties involved.
Eligibility to use the Platform is limited to individuals who are at least eighteen (18) years of age and capable of entering into legally binding agreements. Users agree to provide accurate and complete information and to maintain the integrity of such information.
Each User is responsible for maintaining the confidentiality of account credentials and for all activity conducted under such account. RIFT reserves the right to suspend or terminate any account at its sole discretion.
Use of the Platform is limited to lawful purposes related to real estate opportunities. Users shall not submit false or misleading information, engage in harassment or abuse, attempt to circumvent platform protections, scrape or reverse-engineer the Platform, or use the Platform for any unlawful or unauthorized purpose.
All content submitted by Users, including but not limited to property information, communications, and offers ("User Content"), remains the property of the submitting User. However, submission of User Content grants RIFT a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, analyze, and distribute such content for purposes including but not limited to operating the Platform, improving services, and generating commercial insights.
RIFT reserves the right to use all data collected through the Platform in its sole discretion, including for analytics, product development, and commercial purposes, provided that personally identifiable information is not disclosed to third parties except as required by law.
RIFT does not guarantee the accuracy, completeness, or reliability of any information on the Platform. Users are solely responsible for conducting independent due diligence prior to entering into any transaction.
The Platform may allow for anonymity between users. RIFT is not responsible for any actions taken by users, whether on or off the Platform, including after identity disclosure or transition to off-platform negotiations.
RIFT reserves the right, at any time and in its sole discretion, to monitor, remove, or restrict any content or user activity and to modify or discontinue any aspect of the Platform without notice.
To the fullest extent permitted by law, the Platform is provided on an "as is" and "as available" basis. RIFT disclaims all warranties, express or implied, including but not limited to merchantability and fitness for a particular purpose.
RIFT shall not be liable for any indirect, incidental, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from use of the Platform or any interaction between users.
Users agree to indemnify and hold harmless RIFT from any claims, damages, or liabilities arising from their use of the Platform, their content, or their transactions.
These Terms shall be governed by the laws of [INSERT STATE]. RIFT reserves the right to modify these Terms at any time, with continued use constituting acceptance of any updates.
